CLASS WAIVER

L & G STUDIOS LLC AGREEMENT, WAIVER AND RELEASE I understand that L & G Studios L.L.C., a Michigan limited liability company ("L & G Studios") operates this Pilates studio for which I am voluntarily agreeing to participate in/with. L & G Studios. I agree that L & G Studios allows me to use and participate in their Pilates/fitness business and the equipment located therein (“Pilates Studio”) in exchange for my agreement to the following terms and conditions: 1. I represent and warrant that my use of the Pilates Studio is for my personal use and enjoyment. I will not allow any other person access to the Pilates Studio without the express written consent of L & G Studios. 2. I shall use the Pilates Studio and all the equipment therein in a reasonable and safe manner, in accordance with the manufacturer's design parameters. 3. I agree to be bound by the policies and procedures of L & G Studios as they now exist and as they may from time to time be amended. L & G Studios may, in its sole discretion, deny me access to and use of the Pilates Studio at any time and for any reason, including a failure to abide by the terms of this Agreement. 4. I shall be liable for any property damage and/or personal injury, which I sustain or cause to be sustained by another, regardless of cause. I UNDERSTAND THAT THE USE OF THE PILATES STUDIO AND THE USE OF ITS FACILITIES ARE AT MY OWN PERSONAL RISK AND L & G STUDIOS SHALL NOT BE LIABLE FOR ANY INJURIES OR DAMAGE TO MYSELF OR ANY OTHER PERSON OR BE SUBJECT TO ANY CLAIM, DEMAND, OR LIABILITY AS A RESULT OF INJURIES INCURRED DURING SUCH USE. I, FOR MYSELF AND ON BEHALF OF MY EXECUTORS, ADMINISTRATORS, ASSIGNS, AND SUCCESSORS, DO HEREBY EXPRESSLY FOREVER RELEASE AND DISCHARGE L & G STUDIOS, ITS AGENTS, SUCCESSORS AND ASSIGNS, AS WELL AS ITS OFFICERS AND EMPLOYEES, FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, ACTIONS, OR CAUSES OF ACTION RELATING TO OR RESULTING FROM ANY INJURY OR INJURIES INCURRED BY ME AS A RESULT OF MY USE OF THE PILATES STUDIO. 5. I fully understand and acknowledge that recreational and fitness activities including Pilates have inherent risks, danger, hazards and such exist in my use of such equipment and my participation in these activities. My participation in such activities and or use of such equipment may result in injury or illness including but not limited to bodily harm, disease, strains, fractures, partial and or total paralysis, death or other elements that could cause serious disability. These risks and dangers may be caused by the negligence of representatives, employees, or volunteers of L & G Studios, the negligence of the participants, the negligence of others, accidents, breaches of contract, or other causes. By my participation in these activities and for use of equipment, I hereby assume all risk and dangers and all responsibility for any losses and/or damages whether caused in whole or in part by the negligence or the conduct of the representatives, employees, or volunteers of L & G Studios or by any other person. 6. I represent and warrant that I do not have any disability, impairment, or ailment preventing me from engaging in active or passive exercise or that would be detrimental to my health or physical condition. I acknowledge and agree that L & G Studios will rely on the foregoing warranty in allowing me to use the Pilates studio and that landlord shall have and that L & G Studios shall have no obligation to perform any fitness assessment or similar testing to determine my physical condition. I further acknowledge that should my condition change should my physical condition change, I will inform L & G Studios prior to undertaking any active or passive exercise or use of the Pilates studio. 7. I have received (or have voluntarily and knowingly elected not to receive) independent legal advice with respect to the advisability of entering into this waiver of liability. I acknowledge that I am not entitled to rely upon, nor have in fact relied upon, the legal or other advice of L & G Studios, or its agents, including, but not limited to counsel and employees, in entering into this agreement. 8. By participating in this class, I acknowledge and agree to the following terms regarding the filming of the session for social media purposes: Consent to Filming: I consent to being filmed during the class, which may include video recordings, photographs, and audio recordings. Use of Footage: The footage captured may be used for promotional purposes on various social media platforms, including but not limited to Instagram, TikTok, etc. No Compensation: I understand that there will be no compensation for my appearance in the recordings. Right to Withdraw: If I do not wish to be filmed, I will notify the instructor before the class begins and L & G Studio will do their best to accommodate my request. Release of Liability: I release L & G Studios from any claims or liability related to the use of the recordings as outlined above. I have read and understood this document and I agree to be bound by its terms.
